Terms of Service

Effective August 11, 2026. InstantRebuild is a product of Listening Post Inc, a Nevada corporation.

These Terms of Service ("Terms") govern your use of InstantRebuild ("the Service"), provided by Listening Post Inc ("we," "us," "our"). By creating an account, purchasing a rebuild, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

InstantRebuild reads your existing public website and generates a redesigned version using AI-assisted content extraction and pre-built design templates. You may edit the result using our visual editor and publish it on our hosting platform.

What you get

You pay $50 once for the rebuild of one website. This includes the redesign, AI-generated copy from your existing site content, your choice of 20 professional design templates, a visual editor, and your first month of hosting.

After the first month, hosting costs $19 per month. The monthly plan includes hosting, an SSL certificate, the visual editor, contact form delivery, and support by email.

What happens if you cancel

If you cancel the monthly plan, your site goes offline until you resubscribe. Your content and edits are never deleted for non-payment; they wait for you. You may resubscribe at any time to bring your site back online.

2. Accounts

You sign in by email link. You are responsible for the email address associated with your account and for all activity under it. You must be at least 18 years old to use the Service.

3. Your Content

You own your content

You own your business name, text, photos, and brand. We claim no ownership of your content. By providing a website URL, you confirm you have the right to use that site and its content for this purpose.

What we can do with it

You grant us a limited license to host, store, and display your content as necessary to operate the Service. We do not use your content for any other purpose. We do not sell your content or your customers' information.

AI-generated content

The Service uses AI to read your existing site and generate improved copy. You are responsible for reviewing and approving all AI-generated content before publishing. Facts about your business, including services, hours, and contact details, are your responsibility to verify.

The template system

The rebuilt design is yours to use on our platform while your subscription is active. The underlying template system, code, and design assets remain our property.

4. Payments

How billing works

Payments are processed by Stripe. We never see or store your card number. The $50 rebuild fee is charged at the time of purchase. The $19 monthly hosting charge begins on day 31 after purchase and recurs monthly until cancelled.

Price changes

If we change pricing, we will email you at least 30 days before the new price takes effect. Existing subscriptions continue at their current rate through the end of the current billing period.

You agree not to use the Service to:

6. Third-Party Services

The Service relies on third-party providers: Google Cloud (hosting and AI content generation), Stripe (payment processing), and Resend (email delivery). Each has its own terms of service. We are not responsible for the acts or omissions of these providers.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

9. Indemnification

You agree to indemnify and hold harmless Listening Post Inc from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

10. Termination

You may cancel your account at any time from your dashboard or by emailing support@instantrebuild.com. We may terminate or suspend your account for violation of these Terms, with notice when possible. Upon termination, your site goes offline. Your content is retained for 30 days in case you resubscribe, after which it may be deleted.

11. Dispute Resolution

Any dispute arising from these Terms or the Service will be resolved by binding arbitration in Clark County, Nevada, under the rules of the American Arbitration Association. You waive the right to participate in a class action. The laws of the State of Nevada govern these Terms.

12. Changes to These Terms

We may modify these Terms from time to time. We will email you at least 14 days before any material change takes effect. Continued use of the Service after that date constitutes acceptance of the modified Terms.

13. General

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Listening Post Inc regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right.
